What is it?

A freelance agreement is an agreement between a contractor (a freelancer) and a client. This freelance agreement includes:

• on which model agreement of de Belastingdienst (the Dutch tax authorities) the agreement is based;
• what services the contractor will perform for the client;
• what the remuneration for the contractor will be.

Why do I need it?

You need a freelance agreement to determine the relationship between freelancer and client and most importantly to assure that you do not enter into an employment relationship.

Important tips

Be careful with alterations

This agreement matches the requirements, set out by de Belastingdienst. If you change the document yourself, it could be that de Belastingdienst will rule differently. If you want to make alterations, contact us.

Stick to the contract

When your relationship with your client or contractor is friendly, it's temptuous to just 'go with it'. But the agreement is only 'applicable' when you work accordingly. If you don't do so, there's the risk that de Belastingdienst will assess your relationship as an employment relationship.

Legal explanation 

The assignment agreement is the contract wherein a client hires a service of the contractor. This contractor can be a freelancer, but he can also have employees. 

In May 2016 the regulations have changed for assignment agreements. The VAR (Declaration Employmentrelations) is not used anymore, but the 'model agreement' has become the standard. These modelagreements indicate if relations can be seen as an employment relationship or as an assignment agreement.
