You process personal data, for example, when you use a contact form on your website. You are responsible for the adequate processing of personal data. As the 'data controller' you are obliged to inform visitors on how you use their data. You explain this in a privacy policy. There are high fines on violations, also for smaller companies.

What is it?

A privacy policy is a document in which you explain to visitors (or customers in case of a webshop): which personal data you collect and what you do with it. Data is considered to be 'personal' if you can trace the data back to a person. This is quickly the case. Think for example of someone's name, but also one's bank account number or IP-address.

In this privacy policy you explain, for example:

  • what personal data you process;
  • For which purpose(s) you process the data; and
  • On what legal basis you process the data. 

Why do I need it?

The General Data Protection Regulation (GDPR) has strict rules that oblige you to inform your users and customers extensively. With this privacy policy, you comply with the information obligations in the GDPR and it’s clear for users and customers what you do with their personal data.

Important tips

  • From the beginning, think carefully about making your company "GDPR-proof". This is also called privacy by design. If you make sure from the start that you process personal data in a decent way, this can save you a lot of time, effort (and fines) in the future!
  • In some cases, users must actively consent to what you intend to do with the data. This is the case, for example, when sharing data with third parties. It is then not enough to post the privacy policy on your website, you will also have to actively seek consent from users.
  • If you process personal data on the basis of consent, make sure to ask that consent in the correct way. A good way of asking consent is by an opt-in.
  • As a company, if you use cookies on your site that are not functional or affect user privacy, you are required to inform users about them. This can possibly be included in the privacy policy, but many companies prepare a separate cookie declaration for this purpose. Moreover, for the use of some cookies the user's permission must also be requested by means of a cookie banner. So make sure you have this in order as well.
